Adding a partner to a student visa.

If you have a partner that holds a subclass 500 – Student visa you may be able to be added to their visa.

As the Australia student partner visa applicant, you must:

  • be the spouse or de facto partner of a subclass 500 – Student visa holder
  • have access to sufficient funds to cover your return airfares, tuition fees (if also studying in Australia) and the cost of living in Australia

meet all other criteria for the grant of this visa, including any health and character requirements.

You can be inside or outside Australia at the time of applying for the visa.

You will be granted a student visa with the same work rights that your spouse or partner has on their student visa. Your visa expiry date will be the same date as your spouse or partners student visa expiry date.

Note: If your spouse or partner did not declare your relationship in their 500 – Student visa application then adding you to their visa may not be straightforward. If this is the case, it is highly recommended that you schedule a consultation so we can assess your situation prior to commencement.

Consultation & Assessment

The first step is to schedule a consultation with one of our Registered Migration Agents. During the consultation, we can assess both you and your partner’s current situations, your backgrounds, your relationship and your eligibility to meet the legal requirements for applying for an Australian student partner visa.

Providing you and your sponsor will be eligible to meet the requirements of this visa prior to lodgement we will send you a fixed fee quote following the consultation.

We offer a split fee payment of our professional fees to assist you financially during the preparation stages of your partner visa journey.

We will then look after the entire process for you and assist you with strengthening your supporting evidence prior to lodgement. We have templates to guide you in preparing your evidence in accordance with the applicable legislation. We will provide you with your login details to our secure online portal upon commencement. This portal is used to safely and securely share important and confidential information and documents presented in your applications.

As every relationship and partner visa is different, we will provide you with tailored document checklists relevant to you and your partner’s specific situations.

We will complete all the necessary forms, applications and further submissions on your behalf.

You can rest assured that your Registered Migration Agent has prepared and lodged hundreds of applications similar to yours and is experienced in preparing ‘decision ready’ applications.  It is important that we get it right the first time. For this reason, we will only lodge your applications once we are confident they have been prepared correctly.

Your visa application is lodged with the Department of Home Affairs (the DOHA). The main criterion is that the relationship meets the requirements referred to above. In addition, you must meet the standard health and character checks.

Bridging visa

If you are inside Australia, you will be granted a bridging visa that will allow you to remain inside Australia whilst a decision on your visa is being made. This bridging visa will become active once your current visa expires.

We couldn't be more happy with the experience we have had working with Migration Unity and in particular, Taina Silva, who we couldn't recommend more highly. Right from the outset when applying for our Partner Visa, she was incredibly professional and helpful with everything and then throughout the whole process of applying for our partner visa, she was fast at responding, very well organised with informing us of what we needed to do and compiling evidence for us. Her communication skills with us were second to none which made the process much smoother than it otherwise would have been. She was always on hand to answer any questions we had and was extremely knowledgeable about everything. All of this combined meant Taina made an otherwise extremely complicated and stressful process so much easier. We cannot speak more highly of her and the service provided and will most certainly not think twice about doing our 801 Permanent Partner Visa application with the assistance of Taina. Superb in every way - thank you.

Frequently Asked Questions

What is a subsequent 500 visa?

The subsequent 500 visa allows a partner to be added to an already approved Student visa. This allows the primary visa holder to bring their spouse or de facto partner to Australia or remain in Australia if they are already here on a different visa.

Can same-sex couples be added to a Student visa?

Yes, same-sex couples are eligible to be added to a Student visa. The Australian government recognises and supports same-sex relationships.

Can I include my dependent children in the visa application?

Yes, you can include your dependent children in your application. However, each child must meet certain requirements and there may be additional documentation needed for their inclusion.

What are the requirements to add a partner to a Student visa?

To add a partner to a Student visa, you need to provide evidence of your genuine relationship, such as marriage or de facto relationship documents. You will also need to meet health and character requirements.

Can I work in Australia on a subsequent Student visa?

You must not work in Australia before the primary applicant’s course of study begins.

This restriction will not apply if, at the time the Student (subclass 500) visa application was made, you held a substantive visa or bridging visa that allowed you to work.

You must not work for more than 48 hours during a period of 14 days, where every 14-day period begins on a Monday.

This restriction will not apply if the primary applicant’s course of study is a Master’s degree or a PhD.

Can I apply for permanent residency based on the subsequent Student visa?

Depending on your specific circumstances, you may be eligible to apply for permanent residency through other visa pathways, such as employer-sponsored permanent visas or skilled migration visas. It is advisable to consult with a registered migration agent to explore the available options.

Can I get a bridging visa when being added to a Student visa?

Yes, you may be granted a Bridging visa when being added to a Student visa if you are onshore.

The Bridging visa will come into effect once your previous visa expires and will allow you to remain lawfully in Australia until a decision is made on your subsequent Student visa application. It is important to note that the conditions and rights associated with the Bridging visa may vary, so it’s recommended to consult with a qualified migration agent for specific guidance tailored to your situation.

If you are located offshore you will not be eligible for a bridging visa.

What if my information was not declared in the original Student visa application?

If your spouse or partner did not declare your relationship in their Student visa application then adding you to their visa may not be straightforward. If this is the case, it is highly recommended that you schedule a consultation so we can assess your situation prior to commencement.
