COVID Visa - Important Information
The COVID-19 pathway of the subclass 408 – Temporary Activity visa allows you to temporarily remain in Australia if you work (or have an offer to work) in a critical sector. This visa is valid for up to 12 months.
The minimum requirements for this visa are as follows:
NOTE: You must be IN AUSTRALIA to apply for this visa.
To qualify for a subclass 408 – Temporary Activity visa under this pathway, you must:
- at the time of your application, hold a temporary visa that expires within the next 90 days, OR have previously held a temporary visa that expired within the last 28 days
AND
- not be able to apply for any other temporary visa in Australia (based on your intended activities)
NOTE: the requirement to have no other visa options does not apply if you have an eligible offer of employment in the aged care sector, and you cannot leave Australia due to the COVID-19 Pandemic travel restrictions. In this situation, you will also qualify if you hold a temporary visa that is subject to a ‘no work’ condition (i.e. even if your visa does not expire within the next 90 days)
You must also:
- be employed by (or have an offer of employment from) an employer in one of the following critical sectors: aged care; agriculture; child care; disability care; food processing; health care; or tourism and hospitality to be granted a visa for up to 12 months.
OR
- Be employed by (or have an offer of employment from) an employer in a non critical sector to be granted a visa for up to 6 months
NOTE: If you hold (or last held) a subclass 403 visa under the Seasonal Worker Program (SWP), you must be employed by (or have an offer of employment from) an approved employer under the SWP
- be able to show that your role cannot be filled by an Australian citizen or permanent resident
- if applicable, meet licencing and registration requirements (e.g. medical/nursing)
- genuinely intend to stay temporarily in Australia for the stated purpose
- be able to support yourself financially during your stay in Australia
- have made adequate arrangements for health insurance during your stay in Australia
- meet the relevant health and character requirements
Consultation
The first step is to schedule a consultation with one of our Registered Migration Agents. During the consultation, we will assess your situation and your background. We may also assess your employer and their organisation to determine their eligibility.
Both the employer and employee may attend the initial consultation together if preferred, we offer convenient joint video or phone consultations.

Once you engage in our services, we will conduct an initial assessment of your eligibility for this visa. This involves reviewing your qualifications, work experience and the industry that you are working in (or have been offered to work in) along with other requirements.
Once we have determined that you meet the relevant criteria, we will prepare and lodge your visa application with the Department of Home Affairs (the DOHA). Should your application be approved, you will be granted a temporary visa that allows you to work in Australia for up to 12 months (the exact validity period will depend upon your employer’s requirements).
PLEASE NOTE: We estimate that it may take several weeks to prepare and lodge your application, with the time taken largely dependent on how promptly you provide us with the necessary information and documents. The time that it takes the DOHA to process your application is dependent upon its processing time service standards, and may also vary due to a number of other factors, including the complexity of your case, perceived risk factors and processing priorities.
