What Is 400 Temporary Work Visa?

The purpose of the Highly Specialised Work stream of subclass 400 Temporary Work visa is to allow people to travel to Australia for short-term, highly specialised, non-ongoing work.

Work in Australia

The work that you are to undertake in Australia must be:

  • short-term and non-ongoing
  • highly specialised. In general, this means work that:
    • is classified as a skill level 1–3 occupation in the Australia & New Zealand Standard Classification of Occupations (ANZSCO) OR
    • requires skills or knowledge that are specific to an international company, such as installing imported equipment, after sales service or emergency repairs

NOTE: The work must NOT involve the performance of generic skilled tasks that can be undertaken by similarly qualified and skilled Australian workers.

400 Temporary Work Visa Applicant

As the 400 Temporary Work visa applicant, you must:

  • have the specialised skills, knowledge or experience that is required to perform the work referred to above, and which:
    • can assist Australian business AND
    • cannot reasonably be found in the Australian market
  • genuinely intend to stay in Australia temporarily in order to carry out the relevant work
  • have access to sufficient funds to support yourself whilst you are in Australia

Step 2: 400 Temporary Work Visa Application

Once you have provided the required information and supporting documents, we will prepare and lodge your visa application with the Department of Home Affairs (the ‘DHA’). The main criterion is that you meet the requirements referred to above.

You must be outside Australia both when your application is lodged and when your visa is granted. In addition, you must arrive in Australia within 6 months of your visa grant date. As such, the DHA recommends that you lodge your visa application no more than 6 months before you wish to travel to Australia.

Visa Validity Period

Should your application be approved, you will be granted a temporary visa, allowing you to travel to Australia on a short-term basis. Depending upon your particular circumstances, you will be granted either a single-entry visa (allowing you to enter Australia once, in most cases for up to three months) or, in limited circumstances and where a strong business case is presented, you may be eligible for a multiple entry visa that is valid for up to six months (allowing you to enter Australia multiple times whilst your visa is valid but for no more than six months after your first entry to Australia on the visa).

PLEASE NOTE: We estimate that it may take several weeks to prepare and lodge your application, with the time taken largely dependent on how promptly you (and your sponsor, if applicable) provide us with the necessary supporting information and documents.

The time that it takes the DHA to process your application is dependent upon its processing time service standards, and may also vary due to a number of other factors, including the complexity of your case, perceived risk factors and processing priorities.
